Legal Protection

The Legal Unit of UNHCR Jordan Country Office works for the provision of protection to refugees for their effective access to rights and services in Jordan, in line with UNHCR’s mandate and global legal protection efforts.

UNHCR Jordan’s focus in the Legal Protection domain is protection and access to justice. Among the main areas of engagement, the following ones are noted: civil documentation; legal assistance; protection of refugees in detention and/or at risk of deportation.

That is pursued through provision of different services to refugees, engagement with competent institutions, and capacity development, in close coordination with all relevant partners, to ensure a cohesive and effective response to the protection challenges faced by refugees.

Birth certificates

Access to civil documentation, particularly birth certificates, is crucial for ensuring your legal identity, access to services (like education, healthcare, and other essential services), and protection of your rights.

 

Birth certificate issuance in urban areas:

A birth certificate must then be obtained from the Civil Status and Passports Department (CSPD) of the Ministry of Interior.

Documents required for issuance of a birth certificate are:

  • birth notification stamped and signed from the hospital, doctor, certified midwife, or mukhtar containing all required information;
  • valid family booklet in case the father is Jordanian;
  • proof of marriage (marriage contract, or a marriage ratification decision from Sharia court).

Foreign nationals, including refugees, must provide the following additional information:

  • identity documents of parents, such as passport or national ID card from their country of origin;
  • Ministry of Interior (MoI) service card (for Syrian refugees);
  • Asylum Seeker Certificate (ASC) and national passport number (for refugees from countries other than Syria).

Parents or legal guardians should obtain a birth certificate from any CSPD office within 30 days after birth. If the birth certificate is not obtained within 30 days from the child’s birth, a fine of 10 JOD shall be paid for late registration. If the child is not registered within 12 months of birth the parents must register a case before the competent court in order to issue its decision which will allow them to issue a birth certificate from the CSPD.

 

Birth certificate issuance in refugee camps:

Zaatari Camp: Refugees registered in Zaatari Camp can approach the UNHCR Service Area, where representatives from the Civil Status and Passports Department (CSPD) are available twice per week to facilitate the issuance of birth certificates.

Azraq Camp: Refugees can seek orientation on birth registration at any time from UNHCR protection staff. Additionally, once a week, in collaboration with the civil registration authorities, birth certificates can be issued.

Emirati Jordanian Camp (EJC): Birth certificates are issued every two weeks at the UNHCR offices within the camp.

Garden Camp: Refugees registered in Garden Camp can visit the CSPD office in Al-Ramtha town daily to obtain birth certificates.


Vital incidents documentation

Sharia courts are the primary institutions in Jordan handle matters related to personal status, including marriage, divorce, inheritance, and guardianship. For a comprehensive guide to Sharia courts, including their locations and available services, please visit: https://www.sjd.gov.jo/ 

Zaatari Camp: Refugees registered in Zaatari Camp can access full Sharia Court services at the court office located on the north side of District 5, Block 1. Available services include Marriage, divorce, alimony, and child custody matters.

Azraq Camp: Refugees in Azraq can access Sharia Court services at the court office in Azraq town at any time. Additionally, services are available twice a week within the camp, near the protection area. The following services are provided:

  • Issuance of marriages, divorces, custody documents.
  • Reconciling between spouses.
  • Issuance of travel authorization.
  • Alimony cases.
  • Correction/ modify Sharia documents.
  • Lodging lawsuit related to personal status law.

Garden Camp: Refugees registered in Garden Camp can approach the Sharia Court in Al-Ramtha town daily to issue marriage, divorce, alimony, and child custody documents.

UNHCR Jordan Legal Unit delivers a range of legal services, including legal awareness raising sessions, counseling, representation, mediation, advocacy, in partnership with the Arab Renaissance for Democracy and Development (ARDD), an organization dedicated to promoting human rights, sustainable development, and social justice. Legal awareness raising sessions

UNHCR organizes informative and awareness-raising sessions in urban areas, including Community Support Centers, and within refugee camps.

These sessions cover key topics relevant to both refugees and host communities, for example:

  • Jordan’s legal and policy framework / refugees’ rights and duties
  • Access to legal identity
  • Access to employment opportunities
  • Dangers of drug use and abuse

By providing accurate legal information and guidance, these sessions help participants understand their rights and responsibilities, promote active engagement in society, and strengthen protection mechanisms to support their well-being. Legal counseling

UNHCR, in partnership with ARDD, provides legal counseling services at UNHCR premises, ARDD offices, and within refugee camps. Through legal counseling, you will be provided with guidance on various legal matters, including access to legal identity / civil documentation, rights and duties within judicial and administrative proceedings, access to employment rights. Legal representation

Legal representation is essential in ensuring that refugees can effectively exercise their rights and navigate legal procedures. It provides refugees with professional legal support in matters such as family law, civil documentation, and other legal disputes. Having legal representation can help refugees understand their legal options, present their case before relevant authorities, and secure protection under the law.

Legal mediation

ARDD provides mediation services to help resolve disputes, including rental disagreements that may lead to eviction. These services aim to protect refugees’ rights, prevent forced displacement, and promote peaceful conflict resolution. Mediation may involve negotiations with landlords, legal guidance, and direct follow-up on legal actions. For mediation support, please contact ARDD at:

It will be important for UNHCR to receive as much information as possible about the individuals concerned and the relating circumstances, for more informed and effective support.

Depending on the situation and the needs in the specific case considered, UNHCR will determine which service to provide, for example: protection interviews, legal assistance, issuance of UNHCR certificates.

UNHCR remains in close coordination with competent authorities and parties to safeguard the principle of non-refoulement.
