Which countries apply these rules?
The Dublin III Regulation applies in:
Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia,
Finland, France, Germany, the Netherlands, Hungary, Iceland, Ireland, Italy,
Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Norway, Poland, Portugal,
Romania, Slovakia, Slovenia, Spain, Sweden and Switzerland.
Which country is responsible for your application?
Only one country is responsible.
If you are under 18 and alone
- If a family member is legally in another Dublin country → that country is responsible
- If you have no family in these countries → Slovenia is responsible
If you have close family
- If your spouse/partner or minor children are in another Dublin country → that country may be responsible (if you wish)
If you have documents
- Residence permit (valid or expired within 2 years) → that country is responsible
- Visa (valid or expired within 6 months) → that country is responsible
- Multiple permits or visas → depends on validity and expiry dates
If you travelled through another country
- Entered another Dublin country irregularly → that country is responsible (up to 12 months)
- Stayed irregularly in another country for 5 months → that country is responsible
- Entered legally without a visa → that country may be responsible
Other situations
- Applied in an airport transit area → that country is responsible
- Already applied in another Dublin country → that country is responsible
What happens if another country is responsible?
- Slovenia will not examine your application
- You may be transferred to that country
- This usually happens within 6 months
If no other country is responsible
Slovenia will examine your application.
