Applying for Asylum in China

Who can apply for asylum in China?

You can apply for asylum with UNHCR in China if you are outside your home country and you are fearful of returning there because you believe you will be seriously harmed if you return to your home country due to your race, religion, nationality, political opinion, or if you are a member of a particular social group.

The first step to applying for asylum in China is registering with UNHCR and then going through the Refugee Status Determination process.

Who is a refugee?

A person is considered a refugee if they meet the following conditions:

  • Outside their country of nationality/country of habitual residence; AND
  • Has a well-founded fear of being persecuted because of their race, religion, nationality, membership of a particular social group or political opinion; AND
  • Because of their fear of persecution, is unable or unwilling to avail themselves the protection of their country.

Who is an asylum-seeker?

An asylum-seeker is someone who has applied for refugee status but who has not yet received a decision as to whether s/he has been recognized as a refugee.
