How can I appeal a negative decision?

If your asylum application is denied, you have the right to submit an appeal to the Migration Court. You also have the right to submit an appeal if you have received a residence permit but disagree with the type of status that you have received.

To appeal the decision, you must submit your appeal to the Swedish Migration Agency, which will forward your appeal to the Migration Court. However, before forwarding the appeal to the Migration Court, the Swedish Migration Agency can reconsider its decision.

If you have a lawyer, your lawyer can help you with the appeal. You can contact the Swedish Refugee Law Center if you do not have a lawyer. Note that the appeal must be submitted within 3 weeks from the date when you received the decision from the Swedish Migration Agency. The Migration Court can either changeĀ or confirm the decision made by the Swedish Migration Agency. If the Migration Court confirms the negative decision of the Swedish Migration Agency, you can still appeal to the Migration Court of Appeal.

Until a final decision is made by the Swedish Migration Agency or by the Swedish courts, you are entitled to stay in Sweden with the asylum-seeker status.

You will have to leave Sweden if your appeal is unsuccessful at all stages. You can contact the Swedish Migration Agency if you require assistance to return to your home country.
