Status review for refugees and subsidiary protection holders

If you received refugee or subsidiary protection status in Hungary after 1 June 2016, the National Directorate-General for Aliens Policing (NDGAP) can review your status every three years. This means that the authority will re-examine whether the conditions for granting you protection still apply. The outcome of the status review can result in either maintaining your protection status or its withdrawal. Please note that your status can also be reviewed in case a request for your extradition is received.

Process of the status review

If a status review is initiated, the NDGAP must notify you about it in writing. It is important that you inform the authority about your current address, because they send the official notifications there. Not receiving the notification (because you live somewhere else) does not exempt you from the procedure and keeping its deadlines. If you do not show up in time for the interview requested by the authority, you may risk a negative decision regarding your status.

The authority will call on you to submit reasons why your status should be upheld and prove that there is no basis for exclusion. You will also have to go for a personal interview. The procedure should not take longer than 60 days. If the authority decides to withdraw your protection status, you will have 8 days to submit an appeal against the decision at the authority in person, which will then be forwarded to the court. When deciding about your appeal, the court must hold a personal interview with you and make their decision in 60 days.

Reasons for status withdrawal

The law provides a detailed list of reasons why your protection status can be withdrawn by the NDGAP:

  • You voluntarily return and remain in your country of origin or in the country from where you were fleeing from (suggesting that you again enjoy the protection of your country).
  • You re-acquire your original citizenship or receive a new citizenship and enjoy the protection of that country.

Your status can also be withdrawn, if you decide to renounce your status in writing, or if the authority determines that the conditions for granting you protection no longer apply or did not even exist at the time of your application.

Similarly, if the authority believes that you have failed to disclose important information or misled the authority about it or used fake documents, it can withdraw your protection status.

Status review for tolerated status holders

If you are a tolerated status holder, your status can be reviewed by the authority every year. In case you fail to show up in front of the authority after notification to do so, the authority can automatically withdraw your status.

Please note that if the authority withdraws your tolerated status and you submit an appeal to challenge the decision, the court only holds a personal interview with you if it decides that it is necessary.
