How can I apply for asylum in Serbia?

You may apply for asylum immediately at your first contact with the Border Police. The procedure for seeking asylum in Serbia is as follows:  

  • A foreigner may “express the intention to seek asylum in Serbia” within Serbian territory or at border crossings (including the Nikola Tesla Airport in Belgrade, Nis airport and Kraljevo airport); 
  • Once your intention to seek asylum in Serbia is recorded by the officials of the Ministry of the Interior, you will be issued a certificate of having registered intention to seek asylum; 
  • The asylum-seeker is then expected to go to his/her designated asylum centre, or to notify the Asylum Office should he/she wish to stay in private accommodation; 
  • Upon arrival at the centre/ private accommodation, the asylum-seeker should submit an asylum application with the Asylum Office, which then issues him/her a personal identity document; 
  • The Asylum Office must decide on the application within three months from its submission, during which time one or more hearings are held to establish all the facts and circumstances relevant to rendering the decision. This deadline may be extended to up to nine months. 

I am a recognised refugee/subsidiary protection beneficiary. Can I apply for reunification with family members who are in my country of origin or in another/third country? What are my rights and obligations?

Once your status in Serbia is recognized, you may apply for family reunification.

How can I return to my country of origin?

If you wish to return to your country of origin, you may explore the Assisted Voluntary Return and Reintegration (AVRR) programme that supports migrants to voluntarily return to their countries of origin or to third countries where they have permanent residence. Assisted Voluntary Return and Reintegration (AVRR) is a migration management service offered to migrants and governments by the International Organisation for Migration (IOM). It aims at orderly, humane, and cost-effective return and reintegration of migrants who are unable or unwilling to remain in host/transit countries and who wish to return voluntarily to their countries of origin. The voluntary return programme is conducted in close cooperation with governmental institutions and migrant communities.

How can I apply for resettlement from Serbia to another country? Can UNHCR send me to another country?

Refugees are not entitled to resettlement from Serbia. Final decisions regarding resettlement are taken by the receiving countries and not by UNHCR or the Serbian authorities. Serbia is not considered a country from where resettlement is necessary.  UNHCR does not have a resettlement programme in Serbia.
