Important Information on Entering Libya


Legal Framework for Refugees and Asylum Seekers in Libya

Refugees and asylum seekers planning to enter or move within Libya should be aware that the country enforces specific laws regulating the entry, stay, and exit of all foreigners. These rules are primarily outlined in:

  • Law No. 2 of 2004, which amends Law No. 6 of 1987 on the organization of entry, residence, and departure of foreigners.
  • Law No. 19 of 2010 on Combating Illegal Migration.

Entry and Residence Requirements

  • Entry and exit must occur only through official border points and with authorization from competent authorities.
  • All foreigners must hold a valid visa or equivalent entry document issued by Libyan authorities before entering the country.
  • The duration and conditions of stay are determined by the authorities through relevant executive regulations.

Penalties for Irregular Stay

  • Libyan law imposes penalties for irregular entry, residence, or exit.
  • Individuals without a valid visa or residence permit may face:
    • Detention
    • Financial fine of no less than 2,000 Libyan dinars (Article 19 of Law No. 2 of 2004).

Refugees and asylum seekers are strongly encouraged to follow legal entry and residence procedures and seek accurate information to avoid arrest, detention, or other legal challenges.

 

Acts Punishable Under Libyan Law

The following acts are punishable under Libyan law, with penalties including imprisonment (1–5 years), fines, and deportation after serving the sentence:

  • Illegal entry into Libya or departure through unofficial points
  • Not possessing valid documents
  • Not possessing a valid residency permit

Ignorance of the law is not accepted as an excuse.

  • Article (3) of the Penal Code: “Ignorance of criminal law shall not be invoked as justification for the act.”
  • Article (4): The provisions apply to every Libyan or foreigner who commits, within Libyan territory, any crime stipulated in:
    • Law No. 6 of 1987 (entry, stay, and departure of foreigners)
    • Law No. 19 of 2010 (Combating Illegal Migration)
