Rights

Rights of refugees and asylum seekers in Guatemala:

  • Right not to be returned to the country of origin.
  • Right to non-discrimination.
  • Right to equal and dignified conditions: the refugee must have access to the same opportunities and under the same conditions as Guatemalans.
  • Right to have access to free education in State institutions. If the person already has a university degree, he or she should check with the University of San Carlos de Guatemala about the process to legalize it in the country. This process could cost of approximately Q6,000.00.
  • Right to health: refugees or asylum seekers can attend public health centers and hospitals free of charge.
  • Right to work: refugees and asylum seekers can process work permits issued by the Ministry of Labor and Social Welfare (Mintrab) at no cost.
  • Right to a Special Personal Identity Document.
  • Right to a Special Travel Document: issued to refugees recognized by the State of Guatemala that will be valid for one exit and one entry. It is not a document to return to the country of origin.
  • Right to free movement within the country, which implies being able to change residence at any time.
  • Right to a driving license.
