If your application for refugee or stateless status was declared inadmissible or rejected, you may ask the Ecuadorian authorities to reconsider their decision. This is done through legal remedies such as an appeal or an extraordinary motion for review.
You may file an appeal within 10 business days after receiving the negative notification. The extraordinary motion for review may only be filed based on the grounds and within the time limits established by law.
We understand that filing legal remedies can be complicated if you are not familiar with the country’s laws. If your case was declared inadmissible or rejected, seek free legal advice as soon as possible from the Public Defender’s Office (Defensoría Pública) or the Norwegian Refugee Council.
If you wish to file a remedy on your own, you may do so by following these instructions:
Go to this link to file an appeal (https://www.gob.ec/mremh/tramites/recurso-administrativo-apelacion) or to this link to file an extraordinary motion for review (https://www.gob.ec/mremh/tramites/recurso-administrativo-extraordinario-revision). A page with general information about the process will open; click the button that says “Go to the online procedure,” located at the bottom of the page.
On the online procedure page, you must enter your personal information, including an email address. Use a personal email account that you can access, as all information about your procedure will be sent there.
After completing the information, click “Continue.” A screen will appear asking for a confirmation code. To obtain the code, check the inbox of the email address you entered in the form and look for an email with the subject “Confirmation Code.” There you will find the code, which you must paste into the procedure page.
Click “Continue.” Once you have confirmed that you have access to your email, you can continue filling out the form and attach your written appeal or extraordinary motion for review.
Remember that your written submission must contain, at a minimum:
- Full name and surname(s); identification document number; passport number (if available); marital status; age; profession or occupation; home address; and email address.
- A detailed account of the facts of the case.
- A statement, description, and submission of the evidence you consider necessary.
- The legal provisions on which the remedy is based.
- The authority to whom is addressed: the Undersecretariat for International Protection in the case of an appeal, and the Vice Minister of Human Mobility in the case of an extraordinary motion for review.
- The number identifying the decision declaring the application for refugee or stateless status inadmissible or rejected.
- Your signature.
