{"id":157,"date":"2022-11-01T17:23:49","date_gmt":"2022-11-01T17:23:49","guid":{"rendered":"https:\/\/help.unhcr.org\/portugal\/?page_id=157"},"modified":"2024-12-23T10:51:56","modified_gmt":"2024-12-23T10:51:56","slug":"rights-asylum-seekers","status":"publish","type":"page","link":"https:\/\/help.unhcr.org\/portugal\/rights\/rights-asylum-seekers\/","title":{"rendered":"Asylum Seekers"},"content":{"rendered":"\n<p>As a registered asylum seeker in Portugal, these are your rights and obligations (these rights are maintained throughout the entire procedure, including at the appeal stage):&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-white-color has-text-color has-background\" style=\"background-color:#0072bc\">Rights<\/h3>\n\n\n\n<p class=\"has-text-color\" style=\"color:#0072bc\"><strong><strong>Information about your case<\/strong><\/strong><\/p>\n\n\n\n<div class=\"wp-block-group\"><div class=\"wp-block-group__inner-container is-layout-flow wp-block-group-is-layout-flow\">\n<div class=\"wp-block-group\"><div class=\"wp-block-group__inner-container is-layout-flow wp-block-group-is-layout-flow\">\n<div class=\"wp-block-group\"><div class=\"wp-block-group__inner-container is-layout-flow wp-block-group-is-layout-flow\">\n<p>You have the right to receive information about your asylum application, as well as about your rights and obligations in a language you can understand.<\/p>\n\n\n\n<p class=\"has-text-color\" style=\"color:#0072bc\"><strong>Interpretation throughout the asylum procedure<\/strong><\/p>\n\n\n\n<p>You have the right to be provided with interpretation services in a language you understand.<\/p>\n\n\n\n<p class=\"has-text-color\" style=\"color:#0072bc\"><strong>Free legal assistance<\/strong><\/p>\n\n\n\n<p>You have the right to receive legal counselling throughout the entire asylum procedure. At the appeals stage, you have the right to receive free legal aid by a state-funded lawyer if you do not have sufficient means to hire a private lawyer. <\/p>\n\n\n\n<p class=\"has-text-color\" style=\"color:#0072bc\"><strong>Suspension of any criminal proceeding for irregular entry<\/strong><\/p>\n\n\n\n<p>As an asylum seeker, you cannot be penalized for having entered the country irregularly, for example without adequate documents. Any such penal procedure is suspended until the asylum procedure is concluded. After you have been granted refugee status or subsidiary protection status, any such penal procedure is archived (closed). <\/p>\n<\/div><\/div>\n<\/div><\/div>\n<\/div><\/div>\n\n\n\n<p class=\"has-text-color\" style=\"color:#0072bc\"><strong>Basic assistance<\/strong><\/p>\n\n\n\n<p>As an asylum seeker, you are entitled to basic assistance if you do not have sufficient financial means, which includes accommodation, food, legal, medical and psychosocial assistance. Reception as well as assistance in accessing other services is provided by different institutions, depending on the stage of your asylum procedure:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The <a href=\"https:\/\/cpr.pt\/\" target=\"_blank\" rel=\"noreferrer noopener\">Portuguese Refugee Council (CPR)<\/a>  is the entity responsible for the provision of reception and social support if you are an asylum seeker in the admissibility procedure.<\/li>\n\n\n\n<li>The <a href=\"https:\/\/www.seg-social.pt\/inicio\" target=\"_blank\" rel=\"noreferrer noopener\">Social Security Institute<\/a> is the entity responsible for the provision of reception and social support if you have been admitted to the regular procedure.<\/li>\n\n\n\n<li>The <a href=\"https:\/\/www.scml.pt\/\" target=\"_blank\" rel=\"noreferrer noopener\">Santa Casa da Miseric\u00f3rdia de Lisboa<\/a> is the entity responsible for the provision of reception and social support if your application has been rejected and you have lodged an appeal.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-text-color\" style=\"color:#0072bc\"><strong>Work<\/strong><\/p>\n\n\n\n<p>You have the right to work as soon as you register your asylum application.<\/p>\n\n\n\n<p class=\"has-text-color\" style=\"color:#0072bc\"><strong>Education<\/strong><\/p>\n\n\n\n<p>Children between the ages of 6 and 18 are entitled to free education and education-related allowances in specific cases. For more information, <a rel=\"noreferrer noopener\" href=\"https:\/\/help.unhcr.org\/portugal\/education-and-health\/education\/\" data-type=\"URL\" data-id=\"https:\/\/help.unhcr.org\/portugal\/education-and-health\/education\/\" target=\"_blank\">visit the section dedicated to Education.<\/a><\/p>\n\n\n\n<p class=\"has-text-color\" style=\"color:#0072bc\"><strong>To stay in Portugal until a final decision on your application is taken.<\/strong><\/p>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading has-white-color has-text-color has-background\" style=\"background-color:#0072bc\">Responsibilities<\/h3>\n\n\n\n<p class=\"has-text-color\" style=\"color:#0072bc\"><strong>Respect Portuguese laws<\/strong><\/p>\n\n\n\n<p>Any person residing in the Portuguese territory must obey Portuguese laws, including asylum seekers.
