How to apply for asylum

The Republic of Moldova acceded to the 1951 Convention relating to the Status of Refugees and its 1967 Protocol (hereinafter jointly referred to as the 1951 Convention) in The State acceded to the 1954 Convention relating to the Status of Stateless Persons (the 1954 Convention) and the 1961 Convention on the Reduction of Statelessness (the 1961 Convention) in 2012.

The Refugee Directorate (RD), part of the Bureau for Migration and Asylum (BMA) within the Ministry of Internal Affairs (MIA), is the refugee authority responsible for:

  • Registering asylum-seekers and conducting refugee status determination (RSD) procedures
  • Granting, reviewing, and withdrawing protection
  • Registering applicants for statelessness status and conducting statelessness determination procedure (SDP)
  • Implementing integration programs
  • Managing state financial assistance provided to beneficiaries.

If you apply for asylum at the Border Police, Police offices, and penitentiary or detention center your application will be referred to Asylum and Integration Directorate.

What happens after I apply?

The Asylum and Integration Directorate will register your application, determine your identity, ask you some basic questions, and issue you with a temporary identity document valid for a period of 30 days, with the possibility of being extended for subsequent 30-day terms, until the final decision on your application.

You will be accommodated at the Temporary Accommodation Centre where you will live during the whole period of the asylum procedure.

Examination of your asylum application by the Asylum and Integration Directorate will take up to 6 months or more.

The Asylum and Integration Directorate have to organize an interview with you in the period up to 21 days since you have been applying for asylum. During the interview, the Decision Counselor will ask you questions regarding the information provided in your application, including the information on your identity, on how you came to Moldova, on the reasons why you left your country of origin or other countries where you used to live and the reasons why you cannot return to that country. At the interview, you have the right to be assisted by a translator and lawyer.

In case your asylum application is rejected by the Asylum and Integration Directorate, you have the right to appeal the decision at court on three levels. For the whole procedure, you will still stay legally on the territory of the Republic of Moldova as an asylum seeker.
