{"id":138,"date":"2023-06-22T17:21:39","date_gmt":"2023-06-22T17:21:39","guid":{"rendered":"https:\/\/help.unhcr.org\/malta\/?page_id=138"},"modified":"2025-08-01T08:59:14","modified_gmt":"2025-08-01T08:59:14","slug":"who-decides-on-my-case","status":"publish","type":"page","link":"https:\/\/help.unhcr.org\/malta\/asylum\/who-decides-on-my-case\/","title":{"rendered":"Who decides on my case?"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">Examination of asylum applications<\/h2>\n\n\n\n<p>The IPA will examine your application and make a decision in accordance with <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=celex%3A32011L0095\" target=\"_blank\" rel=\"noreferrer noopener\">European<\/a> and <a href=\"https:\/\/legislation.mt\/eli\/sl\/420.7\/eng\/pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Maltese<\/a> legislation and the <a href=\"https:\/\/www.ohchr.org\/sites\/default\/files\/refugees.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">1951 Convention on the Status of Refugees<\/a>.<\/p>\n\n\n\n<p>The IPA will schedule an interview with you through the contact details that you have provided. The purpose of the personal interview is to ask you questions about your reasons for fleeing your country and assess your claim. &nbsp;<\/p>\n\n\n\n<p>Your interview is an important step in the asylum procedure. It is essential that you present as much evidence and information as you can. It is preferable to request the assistance of interpreters in case your mother tongue is not English (the language in which the interview is conducted). If you face difficulties communicating with the interpreter assigned to you during the interview, you have the right to inform the caseworker and request the services of another interpreter. Don\u2019t worry if you are nervous; you can ask for breaks and clarifications when you need them.<\/p>\n\n\n\n<p>If, for any reason, you cannot attend your interview, you <strong>must<\/strong> inform the IPA as soon as possible. If you could not attend the interview for health reasons, you <strong>must<\/strong> produce a medical certificate from a doctor to prove this. Otherwise, you risk your application being treated as withdrawn.<\/p>\n\n\n\n<p>Based on the interview and assessment of your claim, the IPA can reach one of the following decisions:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>grant&nbsp;<\/strong><strong>refugee status<\/strong><strong>,&nbsp;<\/strong><strong><\/strong><\/li>\n\n\n\n<li><strong>grant subsidiary protection status<\/strong><strong>,&nbsp;<\/strong><strong><\/strong><\/li>\n\n\n\n<li><strong>grant temporary humanitarian protection,<\/strong><\/li>\n\n\n\n<li><strong>reject your application.<\/strong><strong><\/strong><\/li>\n<\/ul>\n\n\n\n<p><strong>The IPA will communicate the decision on your application to you in writing.<\/strong><\/p>\n\n\n\n<p>It is important you always provide IPA with your updated contact details as they will notify you by phone that your decision is ready, and you must attend a decision notification appointment at their premises. It is also possible that the notification is done via email or mail.
