After you have submitted an asylum (international protection) application, the General Department of Immigration (DGIM) will check which country is responsible for processing your asylum (international protection) application, according to the Dublin III Regulation.
Your asylum application (international protection) will be processed in Luxembourg:
- if your digital fingerprints have never been registered (neither in Luxembourg nor in another European Union country);
- if you did not enter the European Union with a visa for one of the other European Union countries;
- if you have never received a residence permit for another European Union country.
If Luxembourg is not responsible for handling your asylum (international protection) application, you will be transferred to the European Union country that is responsible for your application.
If you disagree with the transfer decision, your lawyer may, within 15 days following the notification of the decision, lodge an appeal at the Administrative Tribunal.
- If you cannot afford to pay for a lawyer, you can obtain legal aid free of charge.
Filing an appeal against the transfer decision will suspend the transfer process, meaning you will not be transferred to another European Union country before the Administrative Tribunal decides.
If the Administrative Tribunal upholds the transfer decision, the transfer deadline starts again, and you will be transferred to the responsible European Union country as soon as possible.
If the Administrative Tribunal considers your appeal to be justified, it may reverse the transfer decision, and your asylum application (international protection) will be processed in Luxembourg.
If Luxembourg is responsible for handling your asylum (international protection) application:
- You will meet a social worker from the National Reception Office (ONA) who is in charge of asylum-seekers (international protection applicants) and who can provide information about the different types of aid available;
- Within 8 days of submission of the asylum application (international protection), you must make a declaration of arrival in the commune where you have taken up residence. You may also choose to elect domicile at your representative’s residence (your lawyer’s residence);
- You must undergo a medical check within 6 weeks after entering the country;
- You will receive a letter by mail inviting you to an in-depth personal interview to assess your application for asylum (international protection).
