{"id":134,"date":"2020-06-04T14:05:49","date_gmt":"2020-06-04T14:05:49","guid":{"rendered":"http:\/\/help.unhcr.org\/ireland\/?page_id=134"},"modified":"2025-05-05T13:03:54","modified_gmt":"2025-05-05T13:03:54","slug":"rights-and-duties","status":"publish","type":"page","link":"https:\/\/help.unhcr.org\/ireland\/rights-and-duties\/","title":{"rendered":"Rights and Duties"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\">Rights and Responsibilities of asylum-seekers<\/h3>\n\n\n\n<p>If you are an applicant for international\nprotection (i.e. asylum-seeker) your rights include the following:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Permission to enter and remain in Ireland for the examination of your asylum application by the International Protection Office (IPO) and any appeal to the International Protection Appeals Tribunal (IPAT)<\/li>\n\n\n\n<li>The right to obtain legal advice and representation from a lawyer<\/li>\n\n\n\n<li>The right to be treated with respect, dignity and fairness throughout the single procedure <\/li>\n\n\n\n<li>The right to provide written submissions to the Minister of Justice and Equality in relation to your protection application <\/li>\n\n\n\n<li>The use of an interpreter where necessary to ensure communication <\/li>\n\n\n\n<li>The right to confidentiality<\/li>\n\n\n\n<li>The right to be notified in writing of any interviews, decisions or other relevant notices in relation to your application for international protection <\/li>\n\n\n\n<li>The right to communicate with UNHCR<\/li>\n\n\n\n<li>The right to request permission to access the labour market if you have not received a first instance decision within 6 months of applying for international protection<\/li>\n<\/ul>\n\n\n\n<p>Legal aid is available from the <a href=\"https:\/\/help.unhcr.org\/ireland\/where-to-seek-help\/legal-and-other-support\/\">Legal Aid Board (LAB)<\/a>. They will provide you with one of their own solicitors or with a private solicitor that works with them. The LAB is committed to providing all clients with early legal advice on all aspects of their asylum application. This may include a pre-interview consultation in which legal advice on the particulars of your claim based on your completed questionnaire will be given. The<a href=\"https:\/\/www.irishrefugeecouncil.ie\/early-legal-advice-\"> Irish Refugee Council&#8217;s Independent Law Centre<\/a> also provide early legal advice subject to capacity. If you have the funds you can also seek the services of a private solicitor. <a href=\"https:\/\/www.lawsociety.ie\/find-a-solicitor\/Solicitor-Firm-Search\/\">Just ensure that they are registered with the Law Society of Ireland.<\/a><\/p>\n\n\n\n<p>Depending on the individual circumstances of your application, you may prefer an interpreter of a certain gender present during your interview or appeal hearing. It is important that you raise this as early as possible at the International Protection Office (IPO) and\/or International Protection Appeals Tribunal (IPAT) so they can accommodate this request where possible. <\/p>\n\n\n\n<p>All information provided in relation to your\napplication will be treated in confidence and will not be disclosed to the\nauthorities in your country of origin\/ country of habitual residence or to\nrepresentatives of your country in Ireland.<\/p>\n\n\n\n<p>What are my responsibilities?<\/p>\n\n\n\n<p>Your responsibilities include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Duty to comply with the laws in Ireland<\/li>\n<\/ul>\n\n\n\n<p>This\nmeans you have to respect the laws and regulations of Ireland<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Duty to cooperate<\/li>\n<\/ul>\n\n\n\n<p>As an applicant in the single procedure you have an\nactive duty to cooperate in the examination of your asylum application and in\nthe determination of any appeal in relation to that application. You must also\nsubmit as soon as reasonably practicable all the information needed to\nsubstantiate your application and be truthful. Failure to cooperate may have\nconsequences on the outcome of your asylum application<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Procedural responsibilities<\/h3>\n\n\n\n<p>Part of the duty to cooperate includes the\nfollowing obligations: <\/p>\n\n\n\n<p>a. Not leaving or attempting to leave Ireland during the single procedure without the consent of the Minister for Justice, Home Affairs and Migration;<\/p>\n\n\n\n<p>b. Informing the Minister for Justice, Home Affairs and Migration of your address and any change of address in writing as soon as possible;<\/p>\n\n\n\n<p>c. Complying with reporting notices that you may\nreceive such as a requirement to reside or remain in a specified location or\nplace in Ireland and\/or report at specified intervals to an immigration\nofficer, at a specified Garda (police) station; <\/p>\n\n\n\n<p>d. Indicating your name, address, nationality and\nperson ID number on your temporary residence certificate in any correspondence\nwith the International Protection Office (IPO) or the International Protection\nAppeals Tribunal (IPAT);<\/p>\n\n\n\n<p>e. Being truthful in relation to your application\nfor asylum and completing your questionnaire with relevant information to\nexamine your application;<\/p>\n\n\n\n<p>f. Retaining all copies of documentation given to\nyou by or which you have given to the International Protection Office (IPO) and\nInternational Protection Appeals Tribunal (IPAT);<\/p>\n\n\n\n<p>g.
