{"id":2777,"date":"2026-06-22T14:03:13","date_gmt":"2026-06-22T14:03:13","guid":{"rendered":"https:\/\/help.unhcr.org\/canada\/?page_id=2777"},"modified":"2026-06-25T16:47:14","modified_gmt":"2026-06-25T16:47:14","slug":"first-step-eligibility-interview","status":"publish","type":"page","link":"https:\/\/help.unhcr.org\/canada\/how-to-apply-for-asylum-new\/what-happens-after-you-claim-asylum\/first-step-eligibility-interview\/","title":{"rendered":"First step: Eligibility Interview"},"content":{"rendered":"\n<p>The first stage of the asylum process is the eligibility interview.&nbsp;<strong>After claiming asylum<\/strong>, government officials will conduct an interview to verify your identity, perform a security screening and determine if you are <strong>eligible<\/strong> to have your case assessed by the\u202f<a href=\"https:\/\/help.unhcr.org\/canada\/how-to-apply-for-asylum-new\/who-is-involved\/\">Immigration and Refugee Board of Canada (IRB)<\/a>.<\/p>\n\n\n\n<p>Your\u202fasylum claim <strong>may not be eligible<\/strong> to be referred to the IRB if, for example, you:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Made a previous claim in Canada that was rejected, abandoned, withdrawn or found ineligible;<\/li>\n\n\n\n<li>Have been recognized as a Convention refugee by another country that you can return to without fear;<\/li>\n\n\n\n<li>Made a claim at an official land border post at the Canada-United States border \u2013 unless you qualify for an exception under the STCA;<\/li>\n\n\n\n<li>Made an asylum claim in the United States, the United Kingdom, Australia or New Zealand.<\/li>\n<\/ul>\n\n\n\n<p>Your claim <strong>may also not be eligible<\/strong>&nbsp;to be referred to the&nbsp;IRB&nbsp;if you made your claim <strong>on or after 3 June 2025<\/strong>,&nbsp;<strong>AND<\/strong>&nbsp;:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>You arrived in Canada <strong>after\u00a024 June 2020 <\/strong>and made your claim more than a year later\u00a0(if you entered Canada more than once\u00a0<strong>after\u00a024 June 2020<\/strong>, your first entry date\u00a0is the one that will be considered),\u00a0or\u00a0<\/li>\n\n\n\n<li>You crossed the Canada\u2013U.S. border irregularly and claimed asylum <strong>after 14 days.&nbsp;<\/strong><\/li>\n<\/ul>\n\n\n\n<p>To find out whether you are eligible to apply for asylum according to these laws, you can use the&nbsp;<a href=\"https:\/\/migrantrights.ca\/c12islaw\/\" target=\"_blank\" rel=\"noreferrer noopener\">Migrant Rights Network tool<\/a>.&nbsp;&nbsp;<br><br>You can find the full list of ineligibility reasons on the government\u2019s&nbsp;<a href=\"https:\/\/www.canada.ca\/en\/immigration-refugees-citizenship\/services\/refugees\/claim-protection-inside-canada\/eligibility.html\">website<\/a>.<br><br><strong>!&nbsp;Note :<\/strong>&nbsp;Currently, <strong>unaccompanied minors<\/strong> (persons under the age of 18 who do not have, in Canada, a parent or an adult legally responsible for them at the time of making their claim) are <a href=\"https:\/\/www.canada.ca\/en\/immigration-refugees-citizenship\/corporate\/mandate\/policies-operational-instructions-agreements\/public-policies\/unaccompanied-minors-asylum.html\">exempt from the last two ineligibilities&nbsp;listed<\/a>.&nbsp;&nbsp;<br><br>If you come to Canada to claim asylum, identification is required for you and your accompanying family members to prove who you are and show how you are related. You can prove who you are by presenting to the authorities any of the following identity documents (original or copies):<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Passport<\/li>\n\n\n\n<li>Driver\u2019s license<\/li>\n\n\n\n<li>National identity card<\/li>\n\n\n\n<li>Birth certificate (including the children\u2019s birth certificates)<\/li>\n\n\n\n<li>Marriage certificate<\/li>\n\n\n\n<li>Any other relevant document<\/li>\n<\/ul>\n\n\n\n<p>You must fully cooperate to facilitate your asylum process by:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Answering questions from the Canadian authorities.<\/li>\n\n\n\n<li>Explaining to Canadian authorities how you arrived in Canada.<\/li>\n\n\n\n<li>Showing Canadian authorities any documents used during travel, whether genuine or falsified.<\/li>\n\n\n\n<li>Providing documents that prove your identity.<\/li>\n<\/ul>\n\n\n\n<p>Not cooperating with the Canadian authorities by destroying or hiding identity documents will delay establishing your identity and may place you at risk of being detained. <\/p>\n","protected":false},"excerpt":{"rendered":"<p>The first stage of the asylum process is the eligibility interview.&nbsp;After claiming asylum, government officials will conduct an interview to verify your identity, perform a security screening and determine if you are eligible to have your case assessed by the\u202fImmigration and Refugee Board of Canada (IRB).
