Entry and migratory regularization of Venezuelans in Brazil

In its latest update, Ordinance 670, of April 1, 2022, allows full entry of refugees and migrants into Brazil under the following conditions:

  • By air:
    • Vaccinated travelers must present proof of vaccination;
    • Travelers who are not fully vaccinated, provided that Brazilians and foreigners residing in Brazilian territory, those with a health condition that contraindicates vaccination (attested by a medical report), those not eligible for vaccination due to age or coming from countries with low vaccination coverage: must present to the airline, before boarding, the document proving the performance of a test for Covid-19, with a negative or non-detectable result, such as an antigen test or RT-PCR laboratory performed one day before the moment of boarding;
    • Foreigners who are not fully vaccinated remain prevented from entering the national territory (with exceptions).
  • By land:
    • Brazilians and foreigners must present proof of vaccination at terrestrial control points. The receipt must also be presented, as a condition for boarding, to those responsible for international road and rail passenger transport services.
    • Are exempt from presenting proof of vaccination in land transport:
      • Brazilians and foreigners residing in Brazilian territory who are not fully vaccinated;
      • cargo transport worker under the conditions provided for by the ordinance;
      • traffic from border residents in twin cities;
      • traveler in a situation of vulnerability (humanitarian crisis);
      • from countries with low vaccination coverage;
      • ineligible for vaccination based on age;
      • traveler with a health condition that contraindicates vaccination.
  • By sea:
    • Vaccinated: traveler from international origin, Brazilian or foreign, must present, to the operator or person responsible for the vessel, before boarding, the proof of vaccination, printed or electronically;
    • Vaccinated travelers are exempt from presenting a document proving a test for Covid-19, with a negative or non-detectable result;
    • Travelers who are not fully vaccinated, provided that Brazilians and foreigners residing in Brazilian territory, those with a health condition that contraindicates vaccination (attested by a medical report), those not eligible for vaccination due to age or coming from countries with low vaccination coverage: must present to the operator or person responsible for the vessel, before disembarkation in the country, proof of carrying out a test for Covid-19, with a negative or non-detectable result, such as an antigen test or RT-PCR laboratory performed one day before the moment of the landing.
  • Rules applicable to children:
    • Vaccinated children are covered by the general rules of the ordinance;
    • Unvaccinated children:
      • under the age of twelve, who are traveling accompanied are exempt from presenting tests to screen for infection by the SARS-CoV-2 coronavirus (covid-19), provided that all companions present documents with negative or undetectable laboratory results RT-PCR or antigen test, performed up to one day before departure/entry into the country;
      • aged between two and twelve years, who are traveling unaccompanied, must present documents with a negative or non-detectable result, of the laboratory type RT-PCR or antigen test, carried out within one day before the moment of departure/entry into the country;
      • Children under the age of two do not need to submit tests.

Is it possible for Venezuelans to enter through Santa Elena – Pacaraima?

As provided for in Ordinance 670/2022, there are currently no restrictions on entry for people from other countries, nor for those from Venezuela who enter Brazil via the Santa Elena – Pacaraima border. However, it should be noted that there is a strong demand for immigration regularization at the border between Brazil and Venezuela, which can prolong all the procedures necessary to enter Brazil, as well as remove the documents to which refugees and migrants are entitled in the country.

Are there sanitary measures to enter Brazilian territory?

Can entry be made at any border point in Brazil?

It is understood that the entry of Venezuelans and habitual residents in Venezuela will be allowed through any point of land and air border in Brazil.

What possibilities exist for the migration regularization of Venezuelans?

As provided for in article 17 of Ordinance 670, of April 1, 2022, the immigrant in a situation of vulnerability resulting from a migratory flow caused by a humanitarian crisis recognized by an act of the President of the Republic, pursuant to the sole paragraph of art. 3 of Law No. 13,684, of June 21, 2018, and who entered the country, in the period from March 18, 2020 until the date of publication of this Ordinance, may have their migratory status regularized under the terms of current legislation.

The possibility of regularization before the Federal Police is applicable to the entire Venezuelan population, regardless of where they are in the national territory, whether inside or outside the shelters. The current capacity of the Federal Police is limited, so the process of scheduling appointments for assistance may take some time.

Public defenders and civil society provide free access to requests for documentation. However, you do not need an intermediary to obtain the documentation. Please consider that many people need to go through the documentation process, however the authorities’ capacity is limited so the process can be time consuming. Therefore, it is important that you consult the Federal Police unit closest to your city and civil society actors about the procedures to be followed.

Is there a cost to obtain the documentation?

Do not. Remember that all documentation services in Brazil are free. There is no cost to obtain documentation or receive free legal assistance from public defenders and civil society.

I learned that there is a faster way to issue a Brazilian document that an acquaintance has indicated, paying a sum of money. Can I issue the document for him?

Do not. The issuance of documentation for refugees and migrants (Protocol of Shelter and Provisional Residence) can only be carried out by the Federal Police and directly at the Federal Police unit. Documents that were not issued by the Federal Police are false and you can be held criminally responsible for using them.

Can people of other nationalities be regularized under the flexibility of the Ordinance?

The new ordinance allows the migratory regularization of people who entered Brazil from March 18, 2020 onwards due to humanitarian crises.
